1.1 Introduction

This document is an electronic record published in accordance with the Information Technology Act, 2000 and the rules made thereunder, and the Consumer Protection (E-Commerce) Rules, 2020, and does not require any physical or digital signature. It governs your access to and use of www.haritcare.com and all related mobile or web interfaces (“Website”), operated by SHAAUM CORPORATE PRIVATE LIMITED, trading as “HaritCare” (“Company”, “we”, “us”, “our”), GSTIN 06ABBCS7797P1ZC, having its registered office at Floor No. Sector 48, Building No./Flat No. 63, Duds and Dolls School, NIT, Faridabad, Haryana – 121001, India.

By accessing, browsing, registering on, or placing an order through the Website, you (“User”, “You”, “Your”) agree to be bound by these Terms & Conditions (“Terms”), our Privacy Policy, Shipping Policy, and Return & Refund Policy, all of which are incorporated herein by reference.

1.2 Definitions

• “Website” means www.haritcare.com and any associated mobile application.
• “Company” means SHAAUM CORPORATE PRIVATE LIMITED, operating under the brand name HaritCare.
• “Services” means product sales, nutrition consultation, health coaching, laboratory test booking/facilitation, and other wellness resources offered on the Website.
• “Products” means dietary supplements and wellness products listed for sale on the Website.
• “User” means any visitor, registered customer, or person using the Website or Services.

1.3 Eligibility

You must be at least 18 years of age and competent to contract under the Indian Contract Act, 1872 to purchase Products or Services on the Website. Persons who are minors, of unsound mind, or otherwise incompetent to contract are not eligible to independently use the Website; a minor may use the Website only under the supervision of, and with transactions placed by, a parent or legal guardian.

1.4 Account Registration & Security

• Certain Services require you to create an account using accurate, current, and complete information (name, email, mobile number, and delivery address).
• You are solely responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
• You must notify us immediately at info.haritcare@gmail.com of any unauthorized use of your account or any other breach of security.
• We reserve the right to suspend or terminate any account found to contain false, inaccurate, or misleading information, or associated with suspected fraud or misuse.

1.5 Permitted Use of the Website

You may use the Website only for lawful purposes and in accordance with these Terms. You agree not to:

• Upload or transmit any unlawful, harmful, defamatory, obscene, or otherwise objectionable content;
• Attempt to gain unauthorized access to any part of the Website, other user accounts, or our systems and networks;
• Introduce any virus, malware, or other code of a destructive nature;
• Copy, scrape, reproduce, or distribute Website content without our prior written permission;
• Interfere with, disrupt, or place undue burden on the Website or its infrastructure;
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity;
• Use the Website or Products for any illegal purpose, resale, or commercial redistribution without our authorization.

Any breach of the above may result in immediate suspension or termination of your access, without prior notice.

1.6 Products, Descriptions & Pricing

• We make reasonable efforts to ensure that Product images, descriptions, ingredients, packaging, and pricing displayed on the Website are accurate; however, these are subject to change without prior notice, and actual colour/packaging may vary slightly from what is displayed due to device/screen differences.
• All prices are listed in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise.
• We reserve the right to correct any typographical, pricing, or descriptive errors at any time, including after an order has been placed, and to cancel affected orders with a full refund.
• Listing of a Product on the Website is an invitation to offer, and not an offer for sale; a concluded contract of sale arises only upon our confirmation of the order and successful payment realisation.

1.7 Orders & Payment

• Orders on the Website may be paid for online (prepaid) or through Cash on Delivery (COD), as selected by you at checkout. COD may not be available for all products, order values, or serviceable locations, and an additional COD handling fee (if applicable) will be shown to you at checkout.
• For prepaid orders, we accept payment through the payment gateway(s) integrated on the Website (cards, UPI, net banking, and/or wallets, as enabled from time to time). For COD orders, payment is collected in cash (or, where offered by our delivery/logistics partner, digitally) at the time of delivery.
• We reserve the right to refuse, cancel, or limit any order at our sole discretion, including orders suspected of fraud, resale intent, or policy violation, in which case any amount paid shall be refunded to the original payment method.
• You are responsible for providing accurate billing, contact, and shipping information for each order.
• For COD orders, we reserve the right to seek telephonic/SMS confirmation before dispatch, and to cancel any COD order that cannot be verified, or where repeated non-acceptance of COD deliveries is observed on an account.

1.8 Shipping & Delivery

Shipping and delivery of Products is governed by our Shipping Policy (Section 3 of this document), which forms part of these Terms.

1.9 Returns & Refunds

HaritCare does not accept returns. Replacements and refunds (in limited circumstances) are governed by our Return & Refund Policy (Section 4 of this document), which forms part of these Terms.

1.10 Nutrition Consultation Disclaimer

Nutrition consultations offered through the Website are provided by qualified nutritionists for general wellness guidance only. They do not constitute medical advice, diagnosis, or treatment, and are not a substitute for consultation with a licensed physician. You should consult a qualified medical practitioner for any medical condition, before starting any new supplement regimen, or in case of a medical emergency.

1.11 Health Coach Services Disclaimer

Health Coach services provide lifestyle guidance and motivational support only. Health Coaches do not diagnose medical conditions or prescribe treatment, and their guidance should not be relied upon as a substitute for professional medical advice.

1.12 Laboratory Testing Disclaimer

Where HaritCare facilitates booking of laboratory tests through accredited third-party laboratory partners, the accuracy, timeliness, and content of test reports remain the sole responsibility of the concerned laboratory. HaritCare acts only as a facilitator for such bookings and does not itself conduct, interpret, or certify any laboratory test.

1.13 Medical Disclaimer

HaritCare Products are dietary/nutritional supplements intended to support general wellness. They are not medicines and are not intended to diagnose, treat, cure, or prevent any disease. Please read the label and consult a healthcare professional before use, particularly if you are pregnant, nursing, under medical treatment, or have any pre-existing medical condition or known allergy.

1.14 Intellectual Property Rights

All content on the Website — including but not limited to the HaritCare name, logo, trademarks, product designs, text, graphics, images, videos, and software — is owned by or licensed to the Company. You may view, print, or download extracts for your personal, non-commercial use only. No content may be modified, republished, distributed, or used for commercial purposes without our prior written consent.

1.15 Third-Party Links & Services

The Website may contain links to third-party websites (including payment gateways, courier partners, and laboratory partners) that are not owned or controlled by us. We are not responsible for the content, policies, or practices of any third-party website, and your interactions with such third parties are solely between you and them.

1.16 Disclaimer of Warranties

The Website and Services are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Website will be uninterrupted, timely, secure, or error-free.

1.17 Limitation of Liability

To the maximum extent permitted under applicable law, the Company, its directors, officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Website, Products, or Services. 1.20 Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Subject to applicable consumer protection law (which may allow you to also approach a consumer forum having jurisdiction over your place of residence), any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts at Faridabad, Haryana.

We reserve the right to modify or update these Terms at any time by posting the revised version on the Website with an updated “Last updated” date. Your continued use of the Website following any such change constitutes your acceptance of the revised Terms.
